Jimmy Hula’s Mobile App

End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and Jimmy Hula’s (“Company,” “we,” “our,” or “us”) governing your use of the Jimmy Hula’s mobile application (“App”).

By downloading, installing, accessing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not download or use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for personal, non-commercial use on any mobile device you own or control, subject to this Agreement and any applicable app store rules.

2. Restrictions

You agree not to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or attempt to extract the source code
Sell, rent, sublicense, distribute, or commercially exploit the App
Use the App to violate any laws or engage in fraudulent activity
Interfere with or disrupt the App’s performance or security
Bypass or disable any features, security mechanisms, or restrictions

3. App Functionality

The App allows users to:

Browse menus
Place and manage mobile orders
Save preferences and account information
Locate the nearest Jimmy Hula’s restaurant
View promotions, offers, and loyalty rewards
Manage payment methods (processed by secure third-party partners)

We may update, modify, or remove features at any time without prior notice.

4. Account Registration

To use certain features, you may need to create an account. You agree to:

Provide accurate, current information
Keep your login credentials secure
Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts violating this Agreement.

5. Mobile Ordering & Payments

By placing an order through the App, you agree to:

Pay the total amount shown, including taxes, fees, and tips
Provide valid and authorized payment information
Acknowledge that orders may be fulfilled by third-party delivery partners
Understand that once an order is submitted, modifications may not be possible

All payments are processed securely by our third-party payment processors. Jimmy Hula’s does not store full credit card numbers.

6. Location Services

The App may request access to your device’s location to:

Provide accurate restaurant locations
Improve pickup or delivery options
Offer relevant promotions

You may disable location access, but doing so may limit app functionality.

7. Ownership and Intellectual Property

The App and all related content—including trademarks, logos, text, images, and software—are owned by Jimmy Hula’s or its licensors. Your license does not grant ownership rights.

All rights not expressly granted to you are reserved.

8. Updates & Modifications

We may release updates, patches, or new versions of the App. You agree to:

Receive and install such updates
Understand that the App may not function properly if not updated

We may also discontinue the App at our discretion.

9. Third-Party Services

The App may integrate with third-party tools including:

Payment processors
Delivery partners
Analytics platforms

We are not responsible for third-party services or their privacy practices. Your use of these services may be subject to separate terms.

10. Termination

This Agreement is effective until terminated. We may suspend or terminate your access to the App at any time for:

Violations of this Agreement
Fraudulent or unlawful activity
Technical or security concerns
Discontinuation of the App

Upon termination, you must stop using the App and delete it from your devices.

11. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee:

Uninterrupted or error-free operation
Accuracy of information
Availability of restaurants, menu items, or pricing
That the App will meet your expectations

Your use of the App is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Jimmy Hula’s is not liable for:

Any indirect, incidental, consequential, or punitive damages
Loss of data, revenue, profits, or business
Issues arising from third-party services or delivery partners
Technical problems beyond our control

Our total liability for any claim shall not exceed the amount you paid using the App within the past 6 months.

13. Indemnification

You agree to indemnify and hold Jimmy Hula’s harmless from any claims, damages, liabilities, costs, or fees arising from:

Your misuse of the App
Your violation of this Agreement
Your violation of any law or third-party rights

14. Governing Law

This Agreement is governed by the laws of the state in which Jimmy Hula’s maintains its principal place of business, without regard to conflict-of-law principles.

15. App Store Terms

If downloaded through Apple’s App Store or Google Play:

You agree to comply with their respective terms and conditions
They are not responsible for support, warranty, or claims related to the App
They may enforce this Agreement as third-party beneficiaries

16. Changes to This Agreement

We may update this EULA at any time. Continued use of the App constitutes acceptance of the updated terms.
